Agreement to Terms

Services are customized to meet individual client needs as outlined in care agreements and service plans.

2. Eligibility and Enrollment

To receive our services, you must:

  • Be at least 18 years of age or have a legal guardian
  • Complete our assessment and enrollment process
  • Provide accurate and complete information about health needs
  • Agree to our service terms and care plan
  • Maintain payment arrangements as agreed upon

We reserve the right to refuse service or terminate services if necessary for safety, legal, or ethical reasons.

3. Care Agreements and Scheduling

All services are provided according to a written care agreement that outlines the scope of services, schedule, costs, and responsibilities of both parties. Changes to the care plan require written approval. We will make reasonable efforts to accommodate scheduling requests, but availability may vary. Cancellations must be made at least 24 hours in advance to avoid charges, except in emergencies.

4. Payment and Fees

Payment terms include:

  • Services are billed according to the agreed-upon rate schedule
  • Payment is due within 30 days of invoice date unless otherwise specified
  • Late payments may incur interest charges and service interruption
  • Insurance billing is processed as a courtesy; clients remain responsible for all charges
  • Returned checks or failed payments will incur additional fees

5. Client Responsibilities

Clients and their families agree to:

  • Provide a safe working environment for caregivers
  • Disclose all relevant medical conditions and changes in health status
  • Treat caregivers with respect and professionalism
  • Follow medication and care instructions as directed by healthcare providers
  • Maintain open communication with care coordinators
  • Ensure necessary medical equipment and supplies are available
  • Not request services outside the caregiver's scope of practice

6. Privacy and Confidentiality

We are committed to protecting your privacy in accordance with HIPAA and other applicable laws. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal and health information. All caregivers and staff are bound by confidentiality agreements.

7. Limitation of Liability

While we strive to provide the highest quality care, Active International Marketing shall not be liable for:

  • Changes in client health conditions that are unrelated to our services
  • Decisions made by healthcare providers outside our control
  • Acts of nature, emergencies, or circumstances beyond our control
  • Indirect, incidental, or consequential damages

Our total liability is limited to the amount paid for services in the preceding three months.

8. Termination of Services

Either party may terminate services with written notice:

  • Clients may cancel with 7 days' notice; immediate termination may incur fees
  • We may terminate immediately for non-payment, unsafe conditions, or breach of terms
  • Upon termination, clients remain responsible for all outstanding charges
  • We will assist with transition planning when possible

9. Emergency Situations

In medical emergencies, caregivers are authorized to contact emergency services (911) and may take necessary action to protect client safety. Caregivers are not liable for outcomes resulting from emergency situations when acting in good faith and according to their training.

10. Dispute Resolution

Any disputes arising from these Terms or our services shall first be addressed through good-faith negotiation. If unresolved, disputes will be settled through binding arbitration in accordance with the rules of the American Arbitration Association. Legal proceedings, if necessary, shall be conducted in the jurisdiction where our business is located.

11. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Active International Marketing or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised "Last Updated" date. Continued use of our services after changes are posted constitutes acceptance of the modified Terms. We will notify active clients of material changes.
